Terms of Service
The short version: your league's information belongs to you; you're responsible for what you put in and for telling your players about it; use the service fairly; we'll do our best to keep it running, but we can't promise it never goes down.
1. These terms
PowerSchedule is provided by Southpaw Digital Labs Inc., an Alberta company (“we”, “us”). These terms apply to everyone who uses it. If you set up or manage a league for an organization, you're agreeing to them on that organization's behalf and confirm that you're allowed to. Captains and players using a league's pages agree to the parts that apply to them, mainly section 6.
Our Privacy Policy explains how personal information is handled and is part of these terms.
2. The service
PowerSchedule helps organizations build season schedules, record scores, keep standings and share them with their teams, at an address such as yourleague.powerschedule.ca. We improve the service over time and may add, change or remove features. If we remove something an organization relies on, we'll give reasonable notice.
3. Accounts and access
- Organization admins sign in with a link sent to their email. Keep that email account secure
- Organizations decide who their admins are and who gets each team's PIN, and are responsible for what happens under their accounts
- Tell us right away at hello@powerschedule.ca if you think someone has signed in without permission
4. Your league's information
The information an organization puts in, such as teams, captains, players, schedules, scores and rules, belongs to that organization. It gives us permission to store, process and display it only as needed to provide the service, as described in the Privacy Policy.
The organization is responsible for:
- having the right to enter the information, and keeping it accurate
- telling its captains and players how their information will be used, and getting their consent where the law requires it
- not entering sensitive information the league doesn't need, such as health details or ID numbers
5. Adult leagues only
The service is for adult leagues. Organizations must not add anyone under 18, and anyone signing in must be 18 or older.
6. Using the service fairly
Don't:
- break the law, or post anything harassing, hateful or that you don't have the right to share
- use other people's contact details for anything other than league business
- try to get into another organization's leagues, guess other teams' PINs, or get around security
- overload the service, scrape it, or copy or reverse engineer it
- resell the service, or use invitations or other features to send spam
We may remove content or suspend access that breaks these rules.
7. Fees
Organizations pay up front for a year of service: 12 months from the day their account is set up, and then from each renewal. The price depends on the most teams the organization has at once during that year, as shown on our front page or agreed with us in writing. If an organization grows into a bigger size during the year, it pays the difference for the rest of that year. The service renews each year, and we'll email a reminder at least 30 days before. Payments are processed by Stripe. Prices don't include applicable taxes, which are added to the bill. Because a league's schedule is available as soon as it's set up, fees aren't refunded once we've set up your league, unless the law requires it. If we haven't set anything up yet, we'll refund you in full. If a payment is overdue, we may suspend the organization's admin access after giving notice; its league pages stay readable for its teams for at least 30 days.
8. Availability and support
We work to keep the service running and back it up every day, but we can't promise it will always be available or free of errors. We may take it down briefly for maintenance, preferably outside typical league nights. Support is by email at hello@powerschedule.ca.
9. Ending the service
- An organization can stop using PowerSchedule at any time by telling us
- Before an account closes, the organization can ask for a copy of its league information. We then delete it as described in the Privacy Policy
- We may suspend or close an account that seriously or repeatedly breaks these terms, or if we must by law. Where we can, we'll warn you first and give you time to take a copy of your information
- If we ever stop offering PowerSchedule, we'll give at least 60 days' notice
10. Our software and name
The PowerSchedule software, design and name belong to us. While you use the service, you may use it for your league; that doesn't transfer any ownership to you. If you send us suggestions, we may use them without owing you anything.
11. No guarantees
The service is provided “as is”. Schedules and standings are produced by software from the information and rules you enter, so check them before you publish them. We aren't responsible for running your league, for disputes between teams or players, or for anything that happens at games or venues.
12. Limits on our liability
To the extent the law allows, we aren't liable for indirect or consequential losses, such as lost revenue, lost data that could have been recovered from your own copies, or the cost of replacement services. Our total liability for any claim about the service is limited to the greater of what the organization paid us in the 12 months before the claim and $100 (Canadian). Nothing in these terms limits liability that the law doesn't allow to be limited.
13. Claims against us caused by your information
If someone makes a claim against us because of information an organization entered, or because the organization broke these terms or the law (for example, by adding people without the consent it needed), the organization will cover our reasonable costs of dealing with it.
14. Changes to these terms
We may update these terms. For a significant change we'll email organization admins at least 30 days before it takes effect. Continuing to use the service after that means accepting the new terms.
15. Law and disputes
These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. Any dispute goes to the courts of Alberta. Please talk to us first, though: most problems can be sorted out by email.
16. The rest
These terms and the Privacy Policy, plus any written agreement on price, are the whole agreement between us. If a part of them can't be enforced, the rest still applies. Not enforcing a term right away doesn't mean we give it up. We may transfer these terms if the service changes hands, and we'll tell you if that happens.
